Terms of Service

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site and make purchases. By placing an order, you represent that you meet this requirement and that all information you provide is accurate and complete.

2. Products and Orders

2.1 Product Descriptions

We make every effort to display our products accurately on the Site, including colors, materials, and sizing. However, actual colors may vary depending on your display settings. We do not warrant that product descriptions or other content on the Site are error-free.

2.2 Made-to-Order Production

PHAZD products are made to order. Once an order is placed and confirmed, production begins. This means that orders cannot be canceled or modified after confirmation, except as described in our Returns and Exchanges Policy (Section 5).

2.3 Pricing and Availability

All prices are listed in US dollars and are subject to change without notice. We reserve the right to discontinue any product or drop at any time. Drops are limited and may not be restocked once sold out.

We reserve the right to refuse or cancel any order, including due to pricing errors, suspected fraud, or product unavailability. If your order is canceled, you will receive a full refund.

2.4 Taxes

Applicable sales tax, VAT, or other taxes are calculated and applied at checkout based on your shipping address, in accordance with local laws.

3. Payment

All payments are processed securely through our third-party payment processor. We accept credit and debit cards, Apple Pay, Google Pay, Cash App, Amazon Pay, Link, Klarna, and other payment methods as available at checkout.

By providing payment information, you represent that you are authorized to use the payment method. You agree to pay all charges associated with your order, including product price, shipping, and applicable taxes.

We do not store your full payment card details. All payment data is handled by our payment processor in accordance with PCI-DSS standards.

4. Shipping

We ship to the United States and selected international destinations. Shipping rates are calculated at checkout based on destination and package details.

• Free standard shipping on US orders over $150
• Free international shipping on orders over $250

Estimated delivery times are provided at checkout but are not guaranteed. Delivery times may vary depending on carrier performance, customs processing (for international orders), and other factors outside our control.

Risk of loss and title for items pass to you upon delivery to the carrier. We are not responsible for delays, damage, or loss caused by the shipping carrier after handoff. However, if your order is lost or arrives damaged, please contact us and we will work with you to resolve the issue.

For international orders, you are responsible for any customs duties, import taxes, or fees imposed by your country, unless prepaid at checkout. These charges are not included in the purchase price or shipping cost unless otherwise stated during checkout.

Once an order has been placed, shipping addresses cannot always be changed. Please review your details carefully before completing your purchase.

5. Returns and Exchanges

We accept returns for eligible items in accordance with this policy and any rights that apply under local consumer law.

5.1 General Conditions

• Items must be unworn, unwashed, unused, in original condition, and returned with original tags and packaging
• Returned items will be inspected upon receipt before any refund, exchange, or store credit is processed
• For change-of-mind returns, original shipping charges are non-refundable
• Return shipping costs are the responsibility of the customer unless the item is faulty, damaged, or incorrect
• Items sent back without an approved return request may not be accepted

5.2 Featured Drops and Limited Releases

Items purchased from Featured Drops, limited releases, and made-to-order collections are final sale. These items are not eligible for returns, exchanges, or refunds.

This does not affect your rights in relation to faulty, damaged, incorrect, or misdescribed items, or any statutory rights under applicable consumer law.

5.3 Change-of-Mind Returns

United States and Canada: Eligible items may be returned within 14 days of delivery for store credit only.

United Kingdom and European Union: You may have a legal right to cancel eligible online orders within 14 days of delivery. Where this right applies, returned items must be sent back in accordance with the instructions provided after your return request. Original standard delivery charges will be refunded where required by law.

Australia and New Zealand: Change-of-mind returns are only accepted where this policy allows them. This does not affect your rights in relation to faulty, damaged, incorrect, or misdescribed items.

5.4 Size Exchanges

If you need a different size, you may request an exchange for eligible items within 14 days of delivery. Exchange requests are subject to stock availability.

For US orders, we will ship the replacement item directly once the original item is received and inspected.

For international orders, size exchanges are processed as a return for store credit. You may then place a new order for the correct size. The new order is subject to standard shipping rates unless it meets the free shipping threshold.

If the requested size is unavailable, we may offer store credit or another available solution in line with this policy and applicable law.

5.5 International Returns

For orders shipped outside the United States, approved returns are issued as store credit only, unless otherwise required by applicable consumer law. Return shipping costs for international orders are the responsibility of the customer.

5.6 Faulty, Damaged, Incorrect, or Misdescribed Items

If your item arrives faulty, damaged, incorrect, or not as described, please contact us as soon as possible with your order number and clear photos where possible.

Where required, we will provide an appropriate remedy, which may include a replacement, repair, refund, or store credit, depending on the issue and the law that applies to your order.

Nothing in this policy limits or excludes any rights you may have under applicable consumer law.

5.7 How to Start a Return

To request a return or exchange, contact support@phazd.com with your order number and reason for the request. If your return is approved, we will provide instructions for the next steps.

5.8 Refund Timing

Once your return is received and inspected, any approved refund or store credit will be processed. For orders paid by card, approved refunds are returned to the original payment method. Please allow additional time for your bank or payment provider to post the transaction.

For orders paid with store credit, approved returns are issued as store credit to your PHAZD account.

6. Store Credit

Store credit may be issued for returns, exchanges, or promotional purposes. Store credit is applied to your account and can be used toward future purchases on the Site.

• Store credit has no cash value and cannot be redeemed for cash
• Store credit is non-transferable
• Store credit does not expire
• Promotional or complimentary store credit is not eligible for cash-value redemption or withdrawal under any circumstances

Store credit balances and transactions are tracked through a ledger-based system. In-app notifications will alert you to store credit activity on your account.

7. Intellectual Property

All content on the Site - including but not limited to artwork, designs, drop names, product copy, brand identity, logos, photography, and website design - is the intellectual property of PHAZD or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any PHAZD content without our prior written permission. Purchasing a product does not grant you any intellectual property rights in the designs, artwork, or branding associated with that product.

The PHAZD name, logo, drop names (e.g., "The Dev," "The Shipper," "The Founder"), taglines, and all associated branding are trademarks or trade dress of PHAZD. Unauthorized use of any PHAZD trademark is prohibited.

8. User Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any part of the Site, its servers, or related systems
• Interfere with or disrupt the Site or its infrastructure
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the Site without our written permission
• Submit false or misleading information in connection with orders or communications
• Reproduce, resell, or commercially exploit any PHAZD products or content without authorization

We reserve the right to suspend or terminate your access to the Site if we reasonably believe you are violating these Terms.

9. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that products will meet your specific expectations beyond what is described on the Site.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHAZD AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless PHAZD and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, conducted in North Carolina. You agree that any arbitration shall be conducted on an individual basis and not as a class action or consolidated proceeding.

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

If any provision of this arbitration clause is found unenforceable, the remaining provisions shall remain in effect.

13. Third-Party Services

The Site integrates with third-party services for payment processing, shipping, email delivery, and analytics. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or policies of third-party service providers.

14. Modifications to the Site and Terms

We reserve the right to modify the Site, discontinue products or features, and update these Terms at any time. When we make material changes to these Terms, we will update the "Last Updated" date and, where appropriate, provide notice through the Site or by email.

Your continued use of the Site after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, Shipping and Returns Policy, and any other policies referenced herein, constitute the entire agreement between you and PHAZD regarding your use of the Site and purchase of products.
